1. Agreement to Terms

By accessing or using Training Tiger ("the Service"), operated by Training Tiger LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users of the Service, including visitors who access free resources on our website.

2. Description of Service

Training Tiger is a cloud-based training management and document control platform designed to help organizations manage employee training, track compliance, and maintain audit-ready records for ISO 9001, OSHA, and related regulatory frameworks.

The Service includes:

A subscription-based compliance platform with document control, training assignment, quiz generation, certification tracking, and reporting features
Free downloadable compliance templates available on our website without account registration
Educational articles and guides published on our website

3. Account Registration

To use the subscription-based platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities under your account.

You must be at least 18 years old and have the authority to bind your organization to these terms. One account registration covers your organization; individual employees access the Service under your organization's account.

4. Subscription and Payment

The Service is offered on a subscription basis across multiple tiers (Starter, Standard, and Professional), each with defined user limits. By subscribing, you agree to pay the applicable fees based on your selected plan. Fees are billed monthly in advance and are non-refundable except as required by law.

If your active user count exceeds the limit of your current plan, you will be prompted to upgrade to the appropriate tier. Access may be restricted until the plan is upgraded or user count is reduced.

We reserve the right to change pricing with 30 days' notice. Price changes will take effect at your next billing cycle.

5. Free Trial

We offer a 30-day free trial for new organizational accounts. No credit card is required to start. During the trial, you have full access to all Service features. Free trials are limited to one trial per organization. At the end of the trial, you must subscribe to continue using the Service or your account will be placed in read-only mode, allowing data export but no new activity.

6. AI-Powered Features and Third-Party Processing

The Service includes AI-powered quiz generation, which creates comprehension quiz questions from your uploaded training documents. By using this feature, you consent to the following:

Document content you select for quiz generation is transmitted to Anthropic's API for processing
Anthropic does not use this data to train their AI models, pursuant to their API terms of service
Document content is processed transiently and is not retained by Anthropic beyond the processing request
Generated quiz content is stored in our database and is owned by you

If your organization prohibits transmission of internal documents to third-party AI providers, you should not use the AI quiz generation feature. The Service supports manager-led manual certification as an alternative that does not involve AI processing.

7. Your Data

You retain ownership of all data you upload to the Service ("Your Data"), including documents, training materials, and employee records. You grant us a limited license to store, process, and display Your Data solely to provide the Service to you.

You are responsible for ensuring you have the right to upload and use any content you submit to the Service, including documents and training materials, and that doing so does not violate any third-party rights or applicable laws.

7.1. Analytics and Session Recording

We use third-party analytics tools to improve the Service, including session recording and behavioral tracking inside the authenticated platform. These tools operate under strict data minimization practices — all form inputs are masked by default and no personally identifiable information is captured through session recordings. By using the Service, you consent to this usage as further described in our Privacy Policy.

8. Intellectual Property

Your Content: You retain all ownership rights to documents, training materials, employee records, and other content you upload to the Service.

AI-Generated Content: When you use our AI quiz generation feature, the resulting quiz questions and answers are owned by you. We claim no intellectual property rights over content generated from your documents.

Our Service: The Service itself, including its design, features, underlying technology, and all Training Tiger branding, remains the property of Training Tiger LLC.

Free Resources: Templates and articles published on our website are provided for your use but remain the intellectual property of Training Tiger LLC. You may use and adapt them for your organization's internal purposes but may not resell or redistribute them.

9. Compliance Disclaimer

The Service is a tool designed to help organizations manage training records and document control. It is not a substitute for qualified legal, safety, or compliance counsel. Specifically:

Training Tiger does not guarantee that your use of the Service will result in ISO 9001 certification, OSHA compliance, or compliance with any other regulatory framework
Training records generated by the Service are accurate as of the time they were recorded; we are not responsible for errors introduced by incorrect data entry by your users
You are solely responsible for determining whether the Service meets your organization's specific compliance requirements
We are not responsible if your organization is cited, fined, or sanctioned by any regulatory authority
Templates and guides provided as free resources are for general informational purposes and may not reflect the most current regulatory requirements

10. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to the Service or other accounts
Interfere with or disrupt the Service's infrastructure
Resell or redistribute the Service without authorization
Use the Service to store or transmit content that infringes intellectual property rights
Use automated tools, bots, scripts, or other programmatic means to bulk upload content, scrape data, or otherwise access the Service in a manner that exceeds normal human usage patterns
Use excessive document storage in a manner inconsistent with the intended purpose of the Service. We reserve the right, at our sole discretion, to determine what constitutes excessive use and to evaluate, suspend, or terminate your access to the Service accordingly

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

12. Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to: natural disasters, war, terrorism, riots, pandemics, government actions, power failures, internet or telecommunications failures, or failures of third-party service providers.

13. Data Security

We implement industry-standard security measures to protect Your Data, including encryption in transit (TLS/HTTPS) and at rest. However, no system is completely secure, and you acknowledge the inherent risks of transmitting data over the internet.

14. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation, your access will continue until the end of your current billing period.

We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.

15. Data Export and Deletion

You may export training records and reports at any time using the Service's built-in export features, including CSV export from reports, employee training transcripts, and the skills matrix. Upon account termination, we will retain Your Data for 30 days to allow for export, after which it will be permanently deleted. For bulk data export requests, contact us at support@trainingtiger.co.

16. Limitation of Liability

To the maximum extent permitted by law, Training Tiger LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, including but not limited to damages arising from regulatory citations, audit failures, or compliance deficiencies.

Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

17. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will meet your specific requirements or that it will ensure compliance with any particular standard or regulation. You are responsible for determining whether the Service is suitable for your compliance needs.

18. Indemnification

You agree to indemnify and hold harmless Training Tiger LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any applicable law.

19. Dispute Resolution and Arbitration

Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@trainingtiger.co and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Maricopa County, Arizona.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or unauthorized use of the Service.

20. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the new terms.

21. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Training Tiger LLC regarding your use of the Service and supersede any prior agreements.

23. Assignment

You may not assign or transfer these terms without our prior written consent. We may assign our rights and obligations under these terms without restriction, such as in the event of a merger, acquisition, or sale of assets.

24. Governing Law

These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Subject to the arbitration clause above, any disputes not subject to arbitration shall be resolved in the courts of Maricopa County, Arizona.
